摘要:本文针对广东省高等学校专利数量庞大但转化率长期低迷的突出问题,构建了“产权—能力—生态”三维协同分析框架,系统剖析了高校专利转化困境的制度根源、组织短板与生态制约。研究发现,当前困境的本质是产权激励扭曲、组织能力断层与创新生态割裂三者相互嵌套、彼此强化的系统性失灵。为此,本文提出应以“产权契约化—能力专业化—生态一体化”为核心路径,通过法律规则创新、组织能力再造、生态系统优化与治理体系协同,推动高校专利工作从“数量规模型”向“质量效益型”根本转型。研究进一步从法律解释协同、市场生态培育、治理容错机制等方面提出制度保障建议,并强调省级政府在大湾区知识产权协同治理中的统筹作用,以期为粤港澳大湾区国际科技创新中心建设提供系统性治理方案。

Title: Improvement and Transformation Mechanism of Patent Quality in Guangdong Universities: A Three-Dimensional Framework of Property Right, Capability and Ecosystem
Abstract: This paper addresses the prominent issue of the low conversion rate of patents in higher education institutions in Guangdong Province despite their large quantity. By constructing a three-dimensional synergistic analytical framework of “Property Right—Capability—Ecosystem”, it systematically examines the institutional roots, organizational shortcomings, and ecological constraints hindering patent conversion. The study reveals that the current predicament is essentially a systemic failure resulting from the intertwined and mutually reinforcing distortions in property rights incentives, fractures in organizational capabilities, and fragmentation of the innovation ecosystem. Accordingly, this paper proposes a core pathway centered on “contractualization of property rights, professionalization of capabilities, and integration of the ecosystem”. It advocates for innovation in legal rules, reconstruction of organizational capabilities, optimization of the ecosystem, and synergy in governance systems to fundamentally shift patent-related work in universities from a “quantity-scale model” to a “quality-efficiency model”. Furthermore, the study puts forward institutional safeguards in terms of harmonized legal interpretation, cultivation of a market ecosystem, and fault-tolerant governance mechanisms. It emphasizes the coordinating role of provincial governments in the collaborative governance of intellectual property within the Greater Bay Area, aiming to provide a systematic governance solution for the construction of an international science and technology innovation hub in the Guangdong-Hong Kong-Macao Greater Bay Area.
